Court to rule in CP shootout case
The police have claimed that it was a case of mistaken identity, as they thought they were following a gang of criminals.
 INDIA , 16-October-2007  2:52:35 AM
A court in Delhi will on Tuesday deliver the verdict in what has come to be known as the Connaught Place shootout case of 1997.

ACP SS Rathi and his team from the Crime Branch of the Delhi Police are charged with shooting to death two Delhi businessmen in the Connaught place area on March 31st, 1997.

The police have claimed that it was a case of mistaken identity, as they thought they were following a gang of criminals.

However, the victims' relatives and accounts by senior journalist Kumar Rajesh, who was at the spot of the incident, explain otherwise.

''When I reached, I saw that the cops were circling the area where the blood had spilled. I immediately ran towards my bike to get my cell phone. When I came back, I saw there were some change in the properties,'' said Kumar Rajesh, Senior Journalist.

The deceased were identified as businessmen Pradeep Goyal and Jagjit Singh. An FIR said the Crime Branch team led by ACP SS Rathi fired on the Esteem car, in which the victims were in, after a shot was fired from inside the car.

But the relatives of the victims say that the police fired without provocation.

''It was never a case of mistaken identity. It was a well-planned murder. The cops chased the car for nearly half hour. They could have identified whether the person inside was a criminal,'' said Saif, Pradeep Goyal's Lawyer

Action was taken against Rathi and other policemen, including Inspector Anil Kumar and four Crime Branch constables.

Delhi Police Commissioner Nikhil Kumar was also transferred after a huge outcry.

Thereafter, another FIR was registered after the Lieutenant Governor ordered that the case be transferred to the CBI.

On September 8, 1998, the 10 accused policemen were charged with murder, criminal conspiracy and false evidence.

All the ten policemen including the ACP Rathi were suspended when it was found that the two killed in the encounter were not the criminals but innocent civilians.
