The prosecution will start reading out the evidence against 26/11 convict Ajmal Amir Kasab on Monday as the Bombay High Court takes up his appeal against the death sentence. The court will also take up the state’s appeal against the acquittal of co-accused Fahim Ansari and Sabahuddin Ahmed.
“I will open my case as ordered by the high court and accordingly read the evidence of the witnesses examined at the trial stage, based on which the court will decide whether to uphold the sentence or set it aside,” special public prosecutor Ujjwal Nikam said.
A Division Bench of Justices Ranjana Desai and R V More will simultaneously hear the cases, Kasab’s appeal and also the state’s appeal.
While, Ansari and Ahmed were brought to Mumbai after the high court admitted the state’s appeal, Kasab, who is lodged in Arthur Road prison here, will appear via video conferencing
