When it comes to the BMC polls, or any elections for that matter, each vote counts. Realising this, Juhu resident Mariappa Devendra approached the Bombay High Court yesterday, just hours away from possible externment.
Mariappa's plea to the court was to allow him to stay in town so as to cast his vote in favour of his daughter-in-law Kavita Alex Devendra, an independent candidate from Ward no 64.
Though externment proceedings had not even commenced, Mariappa apprehended that they would, shortly before the voting day.
After much convincing, a bench comprising justices VM Kanade and PD Kode agreed to allow him to stay in Mumbai long enough to be able to exercise his franchise. Appearing on behalf of the petitioner, Advocate Jyoti Chavan said, "The petitioner is my daughter-in-law. Please put a stay on the externment proceedings at least until after the elections. I am approaching the court at this stage because if they extern me before voting day, my efforts will be in vain."
Put on notice
On February 6, Mariappa received a show cause notice and another supplementary notice two days later, seeking to extern him from the Mumbai and Mumbai suburban area. Mariappa applied to the ACP of Santacruz Police station, requesting a week's delay, which was rejected.
The notices mention ten cases, which Mariappa is charged with. However, the accused says he has been acquitted in seven. Mariappa had received a similar notice in March 2009 for the same offences, but the authorities later cancelled the proposal
