Why Gopal Subramanium is no Longer Running For Supreme Court Judge

Senior lawyer Gopal Subramanium, who was Solicitor General for the previous UPA government, has withdrawn from the race to become Supreme Court judge.

Mr Subramanium was "upset at character assassination," sources told NDTV on Wednesday.

The 56-year-old was one of the two lawyers nominated by a Supreme Court collegium - comprising the Chief Justice of India and four seniormost judges - to the top court in May, days before the BJP came to power following its massive victory in the national election.

The new government reportedly did not want him as a judge and the Law Ministry was preparing to ask the collegium to reconsider his nomination.

Mr Subramanium represented the UPA government in the "2G scam", or the alleged allocation of 2G spectrum at throwaway prices to select companies without an auction.

The government has reportedly received "negative inputs" from the Central Bureau of Investigation over his alleged meeting with a lawyer of 2G scam accused former telecom minister A Raja. The agency has reportedly also raised a reference to him in the controversial Radia tapes or the tapped phone conversations of corporate lobbyist Niira Radia, which are under CBI investigation.

Mr Subramanium resigned as Solicitor General in 2011 over differences with the UPA government after a private lawyer was asked to fight the 2G case.

Sources close to him link the new government's opposition to Mr Subramanium to his stint as "friend of the court" in the case involving the 2005 encounter killing of Sohrabuddin Sheikh in Gujarat. BJP leader Amit Shah, who was the state home minister at the time, faces legal scrutiny in the case.

The rules allow the government to ask the Supreme Court collegium to reconsider its choice. But if the collegium sends back the file, the government has to accept it.
