Stick to sealing orders
Delhi Police Commissioner K. K. Paul arrives at the Supreme Court on Wednesday to appear before the Bench.

The Supreme Court on Wednesday directed the Municipal Corporation of Delhi to continue sealing of commercial premises not covered under the protection granted under the new Master Plan for Delhi-2021.

A Bench comprising Justices Arijit Pasayat, C. K. Thakker and L. S. Panta gave this direction, expressing anguish at the manner in which the Court's directions were being implemented by the MCD.

Responding to the Court directions, Delhi Police Commissioner K. K. Paul, other area police officers and MCD Commissioner A. K. Nigam appeared before the Bench. In their affidavits, the Court found conflicting claims by the Police Commissioner and the MCD on making available a police force for the sealing operations. While Mr. Paul said the police force was not provided on April 3 and 4 and that sealing activities were carried out on April 9, the MCD said no police force was made available on all three days. Mr. Paul said that almost the entire available strength of the Delhi police was deployed for the MCD elections from April 3 to 5. On April 3 and 4, police protection was given to the dignitaries who attended the SAARC summit and for the conference. However, police assistance was provided during the MCD drive on April 9, when two pieces of property in North Delhi and four schools in East Delhi were sealed.

But the MCD said the Delhi police themselves communicated to it non-availability of the police force on all three days. This was conveyed in writing by the MCD to the Court-appointed Monitoring Committee.

To a question from the Bench, amicus curiae Ranjit Kumar said the sealing operations were resumed on Tuesday.

In its brief order, the Bench said: "To say the least, the affidavits are confusing and conflicting in some aspects and are un-reconcilable. We express our anguish at the manner in which the orders of this Court are implemented. We want our orders implemented in letter and in spirit.
