| Sunil Kulkarni, a businessman from Mumbai, had seen the black BMW drive over six people in Delhi eight years ago.
In earlier statements, Kulkarni said the driver of the car was referred to as Sanjeev by the two other men who were in the car that night.
But Kulkarni was dropped as a witness by the prosecution despite the fact that two other key witnesses had already turned hostile in the case.
The prosecution alleged that it feared that Kulkarni may go the same way. But in March this year, the trial court summoned Kulkarni.
He was supposed to testify in court today but faxed in a request for police protection because he worries his life is in danger.
An angry judge ordered him to show up right away or be arrested. Within minutes Kulkarni arrived in court but fell sick soon after.
He began describing what happened that night but within ten minutes he asked the court if he could return on Thursday to continue his testimony.
''He deposed and was not feeling well so the court gave him some more days,'' said Ramesh Gupta, defence lawyer.
Kulkarni also got Delhi police protection, something he didn't want, as he had a run-in with them in the past.
He is now expected to come to court on Thursday to narrate what took place on that fateful night.
Since the only survivor in the case has turned hostile, Kulkarni's statement will have a huge impact, not just on the case, but on his own life. If he retracts what he said earlier, he will be guilty of perjury.
