Sunil Kulkarni, key witness in the BMW case, has told the court that prime accused Sanjiv Nanda did not get out of the car from the driver's side.

Nanda, grandson of former Navy chief S M Nanda, along with three others had allegedly killed six people, near Lodhi Hotel on January 10, 1999.

Deposing before Additional Sessions Judge Vinod Kumar, Kulkarni said that it was a ''healthy and hefty'' boy who had come out from the driving seat of the BMW car.

He, however, told the court that the said man was not present in the court room.

Kulkarni was earlier discarded by the court as unreliable but was brought back as witness on a plea by the prosecution.

The defence tried to stall the prosecution move by approaching the High Court which cleared him for giving testimony.

Police pressure

Kulkarni reiterated that it was police pressure which led to certain variations in his statements made at different occasions.

Earlier in the day, the Delhi High Court upheld trial court's order summoning Kulkarni and allowed his cross examination.

''There is no infirmity in the trial court's order and the court shall allow his cross examination. Parties of this case are to appear before the trial court,'' Justice S Ravinder Bhatt said.

Kulkarni had identified Nanda during a court hearing on May 17 as one of the travellers in the BMW.

Nanda had approached the court after the trial court on March 19 had allowed two applications filed by the prosecution -- seeking court's permission to take Nanda's blood sample and to summon Kulkarni for testimony.

Kulkarni was dropped on September 30, 1999, by the prosecution from being examined after two other eye-witnesses Manoj Mallik and Hari Shankar turned hostile in the case
