High Court strikes down Mohammed
Private engineering college managements challenged the order

A Division Bench of the Kerala High Court has held that the P.A. Mohammed-headed Admission Supervisory Committee cannot insist on private self-financing engineering college managements making admissions as per the Common Entrance Examination (CEE) conducted by the Commissioner of Entrance Examinations.

The Bench of Justice K.S. Radhakrishnan and Justice Antony Dominic said on Thursday that since Section 3 of the Kerala Professional Colleges (prohibition of capitation fee, regulation of admission, fixation of non-exploitative fee and other measures to ensure equity and excellence in professional education) Act, 2006 was struck down by a Division Bench earlier, the Committee could not insist that the only safe and sure method to admit students was the CEE.

The Bench observed that the State Government could not insist that the admissions to professional colleges, except for Non-Resident Indian seats, should be made only through the CEE conducted by the State Government-instituted Commissioner of Entrance Examinations.

Panel directive

The court made the observations while quashing an order issued by the Committee on March 21, 2007 directing the self-financing engineering college managements to admit students from the rank list prepared by the Commissioner. The Committee had held that a decision of the consortium of managements to take into account the marks of physics, chemistry and mathematics in Class X and Plus Two along with the marks obtained in the CEE was illegal.

Managements' stance

The petition, challenging the order of the Committee, was filed by the Kerala Self-financing Engineering College Management Association. During the hearing, counsel for the Association said the marks obtained in Plus Two would only be added to the entrance examination marks and that no mark would be given for the interview.
