| Lawyers in Chandigarh have demanded the impeachment and transfer of judge Uma Nath Singh of the Punjab and Haryana High Court.
The Judge had ordered the arrest of a lawyer on Monday and asked for him to be sent to the Agra mental asylum.
His order was stayed by another bench and lawyer Tahar Singh, who was in CBI custody, was released into the custody of a senior advocate.
Tahar Singh was to be produced in court later in the day on charges of dowry harassment filed by his wife but proceedings are stuck because the lawyers have boycotted judge Uma Nath Singh's court.
The advocate's arrest order came after his wife wrote a letter to the court saying she was being tortured for dowry.
She claimed that despite a police complaint filed on July 6, no action had been taken. Taking cognizance of the letter, Justice Singh observed:
''It is also learnt from the Bar that the accused creates nuisance and commotion wherever he goes with the help of some anti-social elements on the strength of some vested interest who finance him in doing so.
In this background, to ensure the safety of life of the complainant and her children, I deem it expedient to direct the SP CBI, Chandigarh to immediately take the accused in custody and take him away from Chandigarh to admit him in the Mental Hospital, Agra for proper treatment.''
Immediately after the verdict CBI arrested advocate Tahar Singh and took him under custody in the CBI office.
But other lawyers, who were not happy with the ruling, demanded withdrawal and recall of the order.
''We will oppose this. This is totally unwarranted. This is misuse of judicial powers vested,'' said Anupam Gupta, Senior Advocate.
As lawyers protested outside the CBI office, the Chief Justice ordered the constitution of a division bench to hear the case.
In its wake, the bench granted interim relief to the advocate, saying there was no need to send him to Agra.
